An employee of a contracted provider agency who is determined by a Department facility to have committed abuse, neglect, or misuse of funds or property against a Department consumer and, consequently, faces placement on the Department’s disqualification registry may appeal that determination before the Hearings Administrator. Department employees have the same appeal rights as contracted provider agency employees.
The Department Hearings Administrator conducts the hearing. The hearing is scheduled to take place within 90 days of the hearing request, but may be continued to a future date. Hearings are held at the Department facility of the determiner but may be held at an alternate location. The Hearings Administrator issues a decision within 20 calendar days of the hearing affirming or reversing the facility determiner’s placement of the employee on the disqualification registry.
