2010 Legislative Update

The 2010 Legislative Session ended May 14. Below are some of the bills that the department tracked.

HB 1226 Fisher, Linda - Specifies that prisoners who commit sexual misconduct in the second degree in the presence of a minor or a person working in a jail, prison, or correctional facility will be guilty of a class D felony
HB 1257 Smith, Joe - Allows criminal charges to be filed against a mother who intentionally used or ingested an illegal controlled substance while she was pregnant which resulted in harm to her unborn child

HB 1296 Lampe- Changes the laws regarding the identification, assessment, and education of children with autism spectrum disorder

HB 1304 Hodges - Requires health insurance coverage to continue for any child or dependent of an enrollee with Down Syndrome after they reach 18 years of age

HB 1377 Brandon - Requires the Department of Social Services to test applicants for or recipients of Temporary Assistance For Needy Families benefits for the illegal use of controlled substances

HB 1918 Sater - Changes the laws regarding public assistance programs administered by the state
HB 1969 Bivins - Makes it a crime for SORTS patients to use bodily fluids to intimidate staff. Adds crimes to list of DMH disqualifying crimes.
HB 1981 Kratky - Authorizes tax credit for businesses that employ persons with disabilities.
HB 1985 Stevenson - Amends various provisions regarding admission of a person for comprehensive psychiatric services
HB 2105 Curls - Allows mental health patients, residents, or clients who receive state-subsidized care or services to have their cases managed by a qualified case worker employed by the state
HB 2242 Walsh - Establishes the Safe Staffing and Quality Care Accountability Act for Veterans Homes and the Safe Staffing and Quality Care Accountability Act for Mental Health Facilities
HB 2273 Cooper - Authorizes the Department of Mental Health to contract with agencies, political subdivisions, and other councils and commissions to promote understanding of mental disorders
HB 2306 Guest - Requires the Department of Mental Health to develop a plan for the transitioning of residents of developmental disabilities facilities to the most appropriate settings
