Adult Transfers
Purpose
When a client is transferred from a DMH facility to the Biggs Forensic Center of Fulton State Hospital, that person must have a due process hearing.
Authority: 630.050 RSMo, DOR 4.533
Pre-Transfer:
- Sending facility contacts hearings officer/designee to schedule a pre-transfer hearing.
- Hearing must be scheduled and held within five (5) working days of service of notice to client.
- Client must be given forty-eight (48) hours advance notice of the hearing.
- Client may request a continuance.
- Decision must be issued within five (5) working days of hearing.
- Decision may be appealed to Director, Department of Mental Health
Copies of the decision are sent to:
- Client (Original)
- Client's attorney/advocate (if appropriate)
- Superintendent of sending facility
- Superintendent of Fulton State Hospital
- Director of Forensic Services (if Forensic)
- Client's guardian (if appropriate)
- Sending facility's representative (The person who presents the case)
Post Transfer
- Biggs Forensic Center contacts hearings officer/designee to schedule a post transfer hearing.
- Hearing must be scheduled and held within five (5) working days of emergency transfer.
- Client must be given forty-eight (48) hours advance notice of the hearing.
- Client may request a continuance.
- Decision must be issued within five (5) working days of hearing.
- Decision may be appealed to Director, Department of Mental Health
Copies of the decision are sent to:
- Client (Original)
- Client's attorney/advocate (if appropriate)
- Superintendent of sending facility
- Superintendent of Fulton State Hospital
- Director of Forensic Services (if forensic)
- Client's guardian (if appropriate)
